1. 100% of the Proceeds of this auction will be used as Prize money & Expenses, Minus any credits used at this auction.

 2. Donating A Stallion Service - Terms & Conditions - No Chute Fee, Handling Fee, or Private Treaty Fees ALLOWED!
Only 1 fee per donated stallion
. The Stallion Auction will accept stallion services of any breed. Contracts are Due on November 28, 2007 to be included in the Stallion Service Auction Catalog. January 15, 2008  Will be the Last Day Nominations will be accepted for the 2008 Stallion Service Auction. These Stallions will be on a supplement sheet, & will be available at the auction, & will be added to catalogs still being mailed out. MWHA will do their best to advertise your stallion, but you will need to help promote your own stallion fee, & the Auction.
A. Donated Stallion Fee Must Be Listed & Sell: at the MWHA Auction or by May 1, 2008  to be eligible for Futurity Classes!
B. Fee: Must be ADVERTISED FEE! If we see it is different anywhere, it will be changed!
C. Standard Breeding Conditions of this auction are: Mare must be in good health, halter broke, broke to tie, no rear shoes, Current on Vaccinations & worming, Neg. Coggins on all out of state mares. All Vet Fees, Boarding fees, and transportation fees / Any Vet Fees needed to get mare in Foal are the Mare Owners Responsibility. Other Requirements by Stallion Owner will be listed with Stallion. (Clean Culture - Neg. Coggins on any horse, Registered Mares Only)
D. Stallion Owner Must List: Any other requirements. Vet IF NEEDED is Standard! Stallion Owner MUST Notify Mare Owner IF a Vet is needed, unless it is an emergency!
E. Guarantees are: Live Foal that stands and Nurse 24 hrs. without assistance. Live Color foal is between Stallion & Mare Owners.
F. Rebreed for mare or substitute mare, is only allowed for the year following the original breeding. Only a one year carry over is allowed. All agreements are between the Stallion Owner & the Mare Owner. Rebreed/ Reclassification/Credit form must be filled out and sent in. Mare Owner must also notify Stallion Owner ASAP. This is not a credit.
G. Vet. certificate will be required on Rebreed/ Reclassification / Credit along with form.
H. Services Sold: are for this year's breeding season, & Service must be used in the year purchased.
I. Stallion & Mare Owners MUST be in Good Standings with Any & ALL Breed Associations.
J.
You do need to join MWHA to donate or buy a fee.  Owner and handler MUST be members of MWHA to show in the futurity.
This is required, so you will get The Arena News, and be kept informed of our events.  We put all of our information in this magazine.
The Arena News is included with your membership.  (We pay your subscription to it out of this money) 
3. The Auction: You must have your own number to bid.   No sharing numbers!
A. Order of the Auction: Stallion Services will be auctioned as they are listed. After the bidding of each horse, Unsold fees will be
available at 60% of their advertised Fee, or minimum of $110.00 - There will be NO 2nd Round!
B. Bidding starts: at 1/2 the advertised fee, or $100.00 Minimum.  Raises are in $25.00 increments.
C. The Highest bidder: shall be the Service Purchaser/ Mare Owner. If any disputes arises between bidders, or two bidders claim the same bid, the bidding will be reopened between those two.
D. Mail in Bids:
will be accepted, if accompanied by a signed form.  A committee member will act as an agent for the bidder, starting with the 1st bid up to / or including the amount bid. The balance of the mail in bid MUST be received within 7 days of notification, after the auction. Raises are in $25.00 Increments   See Payment F.
E. Telephone Bids:
Will be accepted. The Payment of the bid MUST be received within 7 days after notification after the auction. The Stallion will still be listed as Unsold / Pending until money is received. We will not have time, the day of the auction to have call in bids, or to call people at the place of the auction
F. Payment:
Shall be cash, money order, or negotiable check payable immediately after the auction, or purchase of fee. Payments can be made in two (2) payments if over $200.00 (total purchase) 1/2 the night of the auction,  Half payments being made the night of the auction will need to have a second check accompany it for the 2nd half.  The second check will not be processes until May 1 of current year.  Half payments being mailed in will also need to have a second check accompany it for the 2nd half of the payment.  The second check will not be processed until May 1 of Current year.
G. Unsold Stallion Services:
Will be available until May 1, 2008 at 60% of their advertised fee, or $110.00 Minimum. Stallion Owners may purchase their own Unsold Stallion Service at 50% of his own fee, or $100.00 Minimum. Stallion Owner then will also have the responsibilities of the Mare Owner.
H. Insufficient Funds:
Insufficient funds checks will be automatically redeposit. If returned the 2nd time, the purchase will become null & void. If purchaser fails to make good, he/ she will forfeit the breeding and any money already paid, and will be considered in bad standings with MWHA. (Everything will then need to be paid in advance before participating in any MWHA event.) In case of insufficient funds purchase check, the Stallion Owner shall be notified, & given 30 days within to purchase the fee for the remaining amount, if applicable, or the entire fee, if Insufficient funds was on the first check, in order to stay eligible for the futurity.
I. Service Charges:
$25.00 Charge on all Returned checks. Any check issued by MWHA that is lost, and be reissued will be less any Stop Payment and/ or any other charges incurred by MWHA.

 

 

4. Stallion Change of Status / Credits, - NO CASH REFUNDS:

A. In the Event of Death of Stallion, or should he be gelded, or unbreedable, or should Stallion Owner, Manager, leasee refuse to honor contract for any reason; the Mare Owner shall then be eligible to apply funds already paid towards a breeding of equal or greater value, at the auction held in the following year and or current years list of unsold stallions if before May 1 of current year.
B. If after the Auction a Stallion is sold, or leased, and has moved more than 250 miles from the Original Standing Location (at time of auction) the Mare Owner shall then be eligible to apply funds already paid towards a breeding of equal or greater value, at the auction held in the following year.
C. Change of Stallion Status Form: must be filled out and returned!
D. Credits: There will be NO CASH Refunds! Credit form must be filled out and sent in, and approved by the Stallion Auction Committee. Credits must be used at the next year's auction, and only used on, or towards the purchase of stallion service fee(s), any unused amount will be forfeited!
E. Any Credits issued will be subtracted from the purse of the Auction from which it is used.
F. There are no cash refunds!
5. REBREEDS: A Rebreed is: rebreed of mare, or substitute mare in case of failure to conceive, abortion of fetus, or failure of foal to stand and nurse. Vet Certificate will be required, with rebreed/reclassification form. THIS IS NOT A CREDIT! IT IS A REBREED! Must be used in the year following the original purchase to remain eligible for the futurity. Any other rebreed is between the Stallion Owner and the Mare Owner for following years. (Forms must be in by May 30)

6. Stallion Owners Agreement:

A. Breed mares in a manner consistent with their breeding program, and furnish Mare Owner with Breeders Certificate upon birth of live foal.
B. Agree to a one (1) Year rebreed of mare, or substitute mare in case of failure to conceive, abortion of fetus, or failure of foal to stand and nurse.Vet Certificate will be required, with rebreed/reclassification form. Any further rebreed is between the stallion owner and mare owner. ** We will honor a 2nd year carry over if stallion owner does, for futurity eligibility.**
C. Stallion Owner MUST List any additional fees or expenses in catalog information, or any contract to be signed.
D. Stallion Owner will not hold mare owner responsible for any accidental injury, and or death to Stallion.
E. Stallion Owner Must Notify Mare Owner of injuries, and/or before calling a Vet., unless in case of an emergency, or if pre-arranged with mare owner.
F. Stallion Owner can refuse to breed an unbreedable, or mare in poor health.
G. Notify the Stallion Committee Secretary of ANY Stallion Change of Status.
H. Stallion Owner will have 1 entry per Stallion Donated & Sold in the 2007 Closed Weanling Futurity. (Must be nominated or sustaining fee paid.) Nomination Fee of $25.00 + $5.00 Office Charge by June 30, 2007 - See Entry/ Nomination form for all information.
  Sustaining Fee: $5.00

 7. Mare Owners Agreement: Standard Breeding Conditions of this auction are:

Mare must be in good health, halter broke, broke to tie, no rear shoes, current on vaccinations & worming, Neg. Coggins on all out of state mares & Other Requirements by Stallion Owner. Any expenses are due when mare is picked up, before she leaves the property. This includes any costs to get mare in foal, and vet fees.
A. Mare Owners will assume responsibility of all board fees, vet. fees, A I fees, transportation costs.
B. Submit Mare in good Health and Breeding Condition, or have a Vet. inspection if requested by Stallion Owner.
C. Contact Stallion Owner Prior to Mare's arrival time to breeding farm.
D. Sign Breeding Contract & Submit to all stipulations of Stallion Owners contract
E. Mare Owner will not hold Stallion Owner Responsible for accidental injury and/ or death to mare and/ or foal.
F. Fee is for this Breeding Season! Mare Must be taken to Stallion this year, within this years breeding season to be Eligible for the Futurity.
G. If mare becomes unbreedable, or is open, Vet certificate must accompany rebreed/ reclassification form.
H. Transfers of: Fee, Bred Mare, or foal maybe sold, Proper forms MUST accompany these actions & be mailed in, to Stay eligible. MWHA & The Stallion Owner/ Manager MUST be notified also if any of these events occur.
I. Purchasing Mare Owner will have 1 entry per Stallion Purchased (2006 Auction) in the 2007 Closed Weanling Futurity. (Mare Owners resulting Foal out of Mare Owners Mare, or papers with transferred in hand at the show. Must be nominated or sustaining fee paid.) Nomination Fee of $25.00 + $5.00 Office Charge by June 30, 2007 - See Entry/ Nomination form for all information. Sustaining Fee: $5.00
8. All requests for consideration of Reclassification/ Rebreed / Credit: must be filled out on forms provided to Stallion & Purchasing Mare Owners and returned by July 15 of the foaling year. A. Vet certificate is required on Rebreed/Reclassification/ Credit form.
9. All Protests: Must be done within 24 hours of said event. A certified money order in the amount of $250.00, must accompany the written protest. The Stallion Auction Committee and the Current MWHA Board of Directors will review the protest. If protest is proven frivolous, protester will forfeit money. If protest is verifiable, money will be returned.
10. Stallion Owner & Mare Owner MUST BE IN GOOD STANDINGS WITH ALL BREED ASSOCIATIONS!
11. Membership: Must be paid to MWHA to nominate a Stallion Service, or to purchase a Stallion Service, & You must be a paid member of MWHA in Good Standings to Show in any Futurity Class. This includes Owner and Exhibitors if different. All Money will be Held unless membership is paid.
12. MWHA RESERVES THE RIGHT TO REFUSE ANY STALLION NOMINATION.
13. Any Circumstances: Unforeseen, and/ or not covered in the above rules, will be decided on by the MWHA Board of Directors & the Stallion Auction Committee pursuant to the best interests of all parties. The MWHA Board of Directors will have the final decision, and their decision will be final. 
14. The MWHA Board of Directors, reserves the right to interpret, amend, and enforce the above rules.
15. MWHA Board of Directors, & MWHA Stallion Committee is only Communicating the information collected by the Donating Stallion Owners, & is no way responsible for any errors or omissions.
16. MWHA is only acting as the agent for stallion owner / mare owner. All agreements are between the stallion / mare owner.

2008 CLASS DESCRIPTIONS / RULES
ANY ERRORS ON NOMINATION FORMS, WILL REQUIRE PAPERS IN HAND TO BE ABLE TO SHOW!

All Classes require Nomination / Entry Forms - see Form for Information

1. Closed Breeders Weanlings: - Must be Nominated - See Entry/Nomination form for Information & Dates.
A. 1 Foal nomination for the Stallion Owner. Any Foal out of that Stallion, Except for the Mare Owners Foal.
B. 1 Foal Nomination Purchasing Mare Owner - Resulting foal of that Stallion Service
C. Any approved carry over/ rebreeds from the previous year's Auction.
These are the Only 2 Foals Eligible for this class out of each Stallion Sold, at previous Year's Auction.

Nomination forms MUST be sent in. Foal must either be entered or sustaining fee paid as a weanling to stay eligible for the Closed Breeders Classes.  Stallion owner and mare owner will show together. Classes will be Split.

2. Limited Open  Weanlings: All foals out of Stallion that services sold at Current Year's or Previous Year's Stallion Auction. (2007 or 2008)
A. All foals Eligible for the Closed, ARE Eligible for the Ongoing Weanlings also.
3. Closed Breeders Yearlings: Only the 2 foals out of the service sold are eligible, providing the nomination form was sent in. Entry or sustaining fee was paid, as a weanling in 2008. This class is split mares & studs/ geldings - see list
4. Limited Open Yearlings
: All Yearlings out of Stallions whose fee sold at Current years auction, and those that sold at any of the Two (2)previous years auctions. (2006- 2008) This class is split mares & studs/ geldings
5. Limited Open Yearling Longe Line:
All Yearlings out of Stallion Services that sold at Current years auction, and those that sold at any of the Two (2) previous years auctions. NSBA Rules & Score sheets, will apply to this class. ( 2006 - 2008)
6. Limited Open 2 year old Halter:
All 2 year olds out of Stallion Services that sold at Current years auction, and those Stallion Services thathave sold at any of the last 3 years auctions. (2005 - 2008)
7. Closed Breeders 2 year old Snaffle Bit:
Western Tack - AQHA Rules Only the 2 foals out of the service sold are eligible, providing the nomination form was sent in. Entry or sustaining fee was paid as weanling & yearling. See List
8. Limited Open 2 year old Snaffle Bit:
All 2 year olds out of Stallion Services that sold at Current years auction, and those Stallion Service
that have sold at any of the last 3 years auctions. Western Tack - AQHA Rules (2005 - 2008)
9. Limited Open 3 year old pleasure
: All 3 year olds out of stallions whose service was sold at current years auction, or any one auction within the last 4 years Auctions. (2004 - 2008 Pleasure - Tack Optional AQHA Rules will apply to class.
10. Limited Open 4 - 5 Pleasure:
All 4 - 5 Year olds out of Stallions whose service has sold at Current Auction, or any one Auction within the
last 6 years. Pleasure - Tack Optional AQHA Rules will apply to class. (2003- 2008)
11. Limited Open 3 - 5 Halter
: : All 3 - 4 - 5 Year olds out of Stallions whose service has sold at Current Auction, or any one Auction within
the last 6 years. (2003 - 2008)
12.
Open Reining: AQHA Rules apply - Open to all horses, any age, any breed, any rider. ADDED MONEY
ALL Classes Can or will be split:
at the discretion of the MWHA Stallion Committee, pursuant to the best interest of all parties involved. GRADE HORSES - Require Identification Forms from Stallion Owner.

 

RULES FOR NOMINATIONS of Entries:

All Classes Require Nomination/ Entry Form - See Forms for Information.

Office Charge: $5.00 per entry - due & payable with entry - Membership due with Entry if not already paid.

OWNER & HANDLER MUST BE PAID MWHA MEMBERS
Late Postmarked Entries: Will be returned. NO Nomination accepted after Deadline date.
Post Mark Date
:
The Post Office Stamp - Postage Meter Stamps are NOT accepted.
Substitutes/ : There are NO Substitutes once a Nomination has been received, in any class.
Refunds:
There are NO refunds, on nominations.
Check In :
You MUST check In to receive your Number. ALL Weanlings must be checked in by 8:00 AM
Any weanling checking in late after 8:00 AM will pay a $50.00 Late Penalty & foal will go to early class
Split of Classes:
Will be done the day of the Show, by the Actual Amount of Foals Shown.
They will be divided by Birthdate, with any odd numbered foal going to the late class. (You Can check in on Saturday also)
Ties:
Tied Monies will be pooled together and/or split evenly.
STUDS -
Youth 18 or Under Can NOT handle a stallion over Weanling age
Checks
are to be mailed within 15 working days of the futurity.
Judges
:
Names will NOT be Available to Anyone, Until Day of Show!
